I love that this book is being talked about and addressed in the month of October! If you haven’t read it yet consider this your homework assignment. It’s the story of wrongful conviction before wrongful conviction became a national media darling. It’s painful and hard and a really important piece of our cultural dialogue. The Wyly Theatre in Dallas is hosting a “pay for what you can” performance of the play on October 21. More info here.

This insanity has got to stop! Good for Huffington Post for having the imminent execution of Troy Davis as their headline story. The list of celebrities and politicians calling for a stay is tremendous and extends to former FBI chief William Sessions. People (read anyone in Georgia with the power to stop this execution) need to take their egos out of this. A man’s life or death is not the proper subject over which one engages in a “pissing contest”. Yes, it takes a tremendous human being to step back and look if they have made a mistake and take their ego out of the equation and the world is not filled with a huge number of said humans but this is just insanity to the highest degree. Sorry to be such a misanthrope this morning but seriously what kind of society do we live in that allows innocent people to be executed in the name of “finality” in the law or some other legal fiction. This case has all the classic elements of wrongful conviction, faulty identification procedures, hearsay, jailhouse snitch, the list goes on. Check out the Huffington Post story - this has got to stop!!!

Many celebrities including Johnny Depp spoke out on behalf of the Memphis three. DNA evidence does not place them at the crime scene where a boy scouts were found murdered and there was growing doubt about their guilt. It seems that in lieu of a new trial or pleading guilty they have been released with time served and many years probation while allowed to maintain their innocence. Interesting legal dancing. Read more here. Click here for the Huffingtonpost article.

Not in Texas of course, but perhaps equally awe inspiring in Mississippi. Very nice article about a man who lost 10 years of his life as collateral damage in the drug war. Police raided the wrong side of a duplex unannounced and the man pulled a gun and shot a cop while defending his infant child from what he thought were intruders. So clearly self defense and yet he was given the death penalty. After serving 10 years he is home with his family. Crazy case but them most of them are where a miscarriage of justice takes place.

There is reason to be hopeful that Amanda Knox may be released though her family and lawyers are not putting a time frame on it. Independent experts testified and heavily criticized the way evidence was gathered, stored, and tested for DNA in the case. Italian courts are expected to make a ruling in September and the Knox family is reported to be prepared to take the case all the way and not stop fighting until their daughter is home.
I was listening to this on NPR on the way home from work yesterday. Very interesting investigative journalism that seems almost extinct these days. Hearing about any shaken baby case I immediately think about Audrey Edmonds who was wrongfully convicted in Wisconsin and has since been exonerated. I first saw her three years ago at a conference on innocence work being held in Houston and drum roll . . . here is where my total prejudice and ignorance kick in. I was graciously invited by an exoneree to an exoneree only session and each was standing up to tell their name and how long they were wrongfully incarcerated for and there was this pretty lady with long blond hair, nicely dressed, if your from Dallas she looked like she was from the Park Cities and in my mind I thought “oh she is a guest like I am” and then she stood up and spoke about her case that included junk science and “shaken baby syndrome”. Anyway here is a link to an article about the NPR story - Ernie Lopez could be sitting in prison in Texas for a crime he had nothing to do with.

(The Dallas Morning News is running an abridged version of this letter in today’s paper. The did not have space to list all the people who signed it – so here it is in its entirety. Happy Easter Dallas) Dear Editor, Today is a sad day for Justice in Texas. Justice is suppose to be blind but in the case of Benjamine Spencer it is deaf as well. District Attorney Craig Watkins’ has chosen not to acknowledge the overwhelming evidence that points to Ben’s innocence and someone else’s guilt. In the absence of D.A. Watkins’ support, the Court of Criminal Appeals has denied the finding by the district court of Ben’s actual innocence after leaving Ben in limbo and failing to rule for over 3 years. Judge Price even cited the absence of Watkins support as compelling in light of the work done by Watkins in other cases. We cannot see how anyone who conducts a diligent review of the facts could draw a conclusion other than Ben is actually innocent. We believe the D.A.’s office went through the motions to defend their actions but never had any intention of truly seeking justice in this case. In Jennifer Emily’s article [...]

The past 20 years have seen the incarceration rate climb to staggering heights. At the same time, crime has fallen. Why is it our government feels the need to continue to punish when the punishment is no longer taking effect. Dallas Can Do Better is an organization called to defend the rights of those wrongfully punished and incarcerated. It’s dedication to this purpose helps make the cases of wrongfully imprisoned men like Ben Spencer. However, it’s tragic to think that we even need such an organization. With advancements in technology one would think our criminal justice system would better serve our society by lessening the amount of punishment and effectively diminishing the amount of crime. Yet we see that these advancements do not mean an effective justice system. Wrongfully accused men sit in our jails and prisons today and continue to suffer despite evidence and technologies available to overturn their sentences. If anyone is interested in the afformenioned topic, Mark Kleiman’s book “When Brute Force Fails” is a fascinating read. The book analyzes the current state of crime and justice in the United States and goes on to present various strategies as to how to continue our nation’s declining crime [...]
